Agreement For Using Site Services

The Omid Health Style Site Service Usage Agreement (Agreement) between the User as the user of the Omid Health Style site (User) and Omid Health Style as the manager of this site contains the terms and conditions for using the site services that apply to Users to be able to use the Omid Health Style site. Omid health style can herein after also be referred to as “We”.

Please read this Agreement carefully. You’ll need to read, understand, accept, and agree to all the terms and conditions in this Agreement before using the application and/or receiving the content contained therein.

By using the application and/or continuing to access the Omid Health Style site, you agree to Our terms and conditions and therefore agree to be bound by a contract with Us, you express your agreement to be able to receive services and access to all content contained in this application.

If you do not accept and agree to this Agreement, you are not permitted to further access the Omid Health Style site and are welcome to leave the site.

Any activity related to the use of the site, then both the organizer, the user in this case also includes the seller (merchant) and the buyer, are legally protected through Law of the Republic of Indonesia No. 11 of 2008 concerning Information and Technology, Law of the Republic of Indonesia No. 19 of 2002 concerning Copyright, and against all forms of obligations arising from all activities on the Omid Health Style site have met the rules and requirements for the validity of an obligation as stated in the Indonesian Civil Code.

Introduction

This Agreement is governed and interpreted based on the Law of the Republic of Indonesia (Indonesia). The parties mentioned in this Agreement hereby agree to submit to the courts in Indonesia.
In this Agreement, the term “User” means an individual, whether an Indonesian citizen, a foreign citizen, or a legal entity with the ability to use a computer, network, computer, and/or other electronic media capable of accessing the Omid Health Style site according to their needs. This also includes Users who have registered on the Omid Health Style site as Registered Users or Users who pay for certain services that may be provided by the Omid Health Style site
By accessing or using the Omid Health Style site, Users who are included in the category of Users as mentioned in point 1.2. above consciously and without coercion from any party declare themselves to agree to accept all the terms and conditions stated in this Agreement. As a User, the User is bound by the terms and conditions in the Agreement that apply if the User accesses or uses the site. If the User does not accept all the terms and conditions in this Agreement, the User is required to immediately leave the Omid Health Style site.
We may change or update this Agreement at any time by listing the amended or updated Agreement on the site and the amended and updated terms and conditions will be effective immediately after the amended and updated terms and conditions are listed by the Omid Health Style site, and the User is required to read the new terms and conditions at all times and is deemed to have agreed to the changes or updates if after being listed on the site and the User continues to use the Omid Health Style site.
On the Omid Health Style site there will be or have been connections or hyperlinks (Links) that are connected to third-party sites contained in Links outside the site and We hereby declare that we are not responsible for the contents of Links outside the site or sites provided or installed by third parties (Third Party Content).

General Terms Of Use of The Site

When visiting and using this site, including all its features and services, each User is required to comply with the following Site User provisions:

Users must be at least 17 years old or have legally recognized requirements including in the category of Adult Users / independent of the Child Protection Law.
Each User agrees not to copy, use, or download all information, writings, images, video recordings, directories, documents, databases, or advertisements on the Omid Health Style site or obtained through the Omid Health Style site for any purpose including and not limited to reselling or redistributing the contents of the Omid Health Style site, conducting mass marketing (via email, SMS, regular mail or others), running a business to compete with the Omid Health Style site or utilizing the Omid Health Style site for commercial purposes outside of transaction activities with Omid Health Style Users are not allowed to systematically take the contents of the Omid Health Style site to create or compile, either directly or indirectly, a collection, compilation, database, or directory (either using automatic devices or manual processes) without written permission from Us. In addition, Users are not allowed to use the contents or materials above for any purpose not stated in this Agreement.
When visiting and using the Omid Health Style site, including all its features and services, each User is not permitted to:

violate any applicable laws (including but not limited to regulations regarding export control, consumer protection, unfair competition, anti-discrimination, or false advertising), the rights of other parties, whether intellectual, human, or other rights and the rules set out in this Agreement.
Providing information and content that is false, inaccurate, misleading, defamatory, obscene, pornographic, discriminatory or racist.
take actions that may disrupt the suggestion or input system and/or ratings (such as displaying, importing, or exporting information or input from external sites or using it for purposes unrelated to the Omid Health Style site).
Provide an account on the Omid Health Style site (including suggestions or input) and account name to another party without our knowledge.
Spreading spam, obscene material, or large numbers of electronic messages, or continuous messages.
Spreading viruses or any other similar technology that can damage and/or harm the Omid Health Style site, its affiliates, and other users.
Inserting or adding features to the Omid Health Style site without our knowledge and consent is not permitted.
Store, copy, change, or distribute the content and features of the Omid Health Style site, including the service methods, content, copyright, and intellectual property contained on the Omid Health Style site.
Harvesting or collecting information from other users, including email addresses, without the knowledge of other users.

4. We reserve the right to limit or not provide access, or provide different access to be able to open the Omid Health Style site and its features to each User, replace one of the features, or enter a new feature without prior notice. Each User is aware that if the Omid Health Style site cannot be used in whole or in part for any reason, then any business or activity carried out by the User may be disrupted. Each User hereby agrees that for any reason we will release ourselves from any form of responsibility to the User or a third party if the person concerned cannot use the Omid Health Style Site (either due to disruption, limited access, changes to features or the exclusion of certain features or for other reasons); or if communication or transmission is delayed, fails or cannot take place; or if losses arise (directly, indirectly) due to the use or inability to use the Omid Health Style site or one of its features.

5. By continuing to access or continue to use the Omid Health Style site, the User is deemed to have read, understood, and agreed to the provisions of the Omid Health Style site regarding the Privacy Policy which regulates the use of the information entered by each User into the Omid Health Style site. The User accepts these provisions as well as any additions changes or updates. The User understands and is aware that We may change the provisions regarding this Privacy Policy at any time and will include the latest version on the Omid Health Style site. If you continue to use the Omid Health Style site, the User is deemed to accept and agree to the provisions regarding the Privacy Policy listed on the Omid Health Style site at the time of use.

6. Users acknowledge and agree that the prices listed on the Omid Health Style site may change at any time and without prior notice.

7. Access to this site is only permitted for the purposes and interests of shopping and information related to the services of this site.

8. Users are not permitted to reproduce, distribute, display, sell, rent, transmit, create derivative works from, translate, modify, reverse engineer, disassemble, decompile, or exploit this site.

9. Users are not permitted to create and publish content that:

Infringes any copyright, patent, trademark, service mark, trade secret, or other proprietary right.
Is threatening, obscene, pornographic, or could give rise to any civil or criminal liability under Indonesian or international law.
Contains bugs, viruses, worms, trap doors, Trojan horses, or other harmful code or properties.

Registered User (Customer Data Privacy Policy)

Becoming a Registered User, hereinafter referred to as “Omid Health Style Member”, is free of charge.
By creating an account as a member of the Omid Health Style site, members will create an account name and password when completing the registration process.
Members of Omid Health Style are responsible for maintaining the confidentiality and security of their account names and passwords, and registered users are fully responsible for all activities carried out under the name of the registered user account.
We reserve the right to restrict, suspend, or terminate an account, restrict access to Omid Health Style, and take legal action against users who violate laws, intellectual property rights, or this Agreement.
Member Omid Health Style is prohibited from selling, attempting to sell, offering to sell, giving, submitting, or transferring their account without written consent. They may be suspended or terminated for violating provisions, with all consequences and risks being the responsibility of the transferred member.

6. Member Omid Health Style agrees to:

Immediately notify Us of any suspected unauthorized/invalid use under the name of Your Member account
Ensure that Omid Health Style Members log out of their accounts at the end of each activity on the Omid Health Style site to avoid the possibility of misuse of the account in question.

Registered User (Customer Data Privacy Policy)

Each User is obliged to pay in full for transactions carried out by the transaction and payment provisions.
Each User is responsible for all things done on the Omid Health Style site under the User’s name.
Each User is fully responsible if the User violates the provisions detailed in this Agreement, and agrees to release Us and its affiliates from all losses resulting from violations committed by the User.
Users have the right to receive goods/products that are appropriate and have been paid in full in advance by the User and cannot be returned or canceled unilaterally by the User.
Users are entitled to receive goods/products that have been paid for in full as long as the goods/products are listed with the correct price and discount and do not contain incorrect information, including but not limited to errors resulting from typing errors or errors in the Omid Health Style site’s operational system.

Product Description

Omid Health Style always tries to provide the most accurate product descriptions possible. However, we cannot 100% guarantee that all descriptions or content contained on the website are accurate, complete, up-to-date, or error-free. If the product offered by us does not match the one stated in the product description, then you can return it in an unused/unsealed condition.

Price

If in certain circumstances, there is an error in price or information about a particular product caused by a typo or price error and information from the supplier or human error and system error, we have the right to reject or cancel orders that use the wrong price including orders that have been paid. And we are not responsible if you sell/re-market our products before there is an agreement or transaction process between us and you as a customer/visitor to our website.

Review & Comment

All Comments and Reviews written on this website will be categorized and treated as non-confidential content.
The reviews that have been described become the property of Omid Health Style and cannot be returned.
You are prohibited from writing using someone else’s identity.
You are prohibited from writing comments or reviews that contain abusive language towards Omid Health Style or other third parties.
Omid Health Style has the right to change or delete comments and reviews that contain elements of sentences that are not suitable for broadcast (SARA, Pornography, Harassment, Insults, Defamation, etc.).

Payment Term

We work with trusted banking/payment service providers to provide various payment methods that can be used by Users.
Each User has the right to choose a payment method that has been provided by Us, whichever User feels is more convenient and easier in transacting with the Omid Health Style site, where each payment transaction fee will be deferred to the user.
Each User is obliged to pay in full for the order made within the time period specified by Us specifically for each payment method before We can further process the User’s order. If the User has not made payment within the specified time period, We have the right to declare that the order has been cancelled by the User.
Each User can clarify payment transactions that have been carried out directly to the banking service provider that cooperates with Us in accordance with the applicable terms and conditions.

Transaction

The prices listed in the Omid Health Style website product catalog do not include shipping costs, fleet rates or couriers outside the city (expedition).
For online purchases via the shopping cart, orders and shipping will be processed after payment is received by Omid Health Style.
The delivery time is adjusted according to the service area of the destination area.
For deliveries using expeditions, Omid Health Style collaborates with courier services with insurance to prevent loss or damage during the trip.
Some items are not ex-stock so prior ordering is required.
Every product purchased from us comes with a warranty period that is adjusted to the manufacturer’s warranty for each product.
Goods that have been purchased cannot be returned or exchanged for other goods, unless there is a prior agreement.
Every effort has been made to ensure the accuracy of all information contained. Omid Health Style does not guarantee with any respect the accuracy of such data, including product specifications or editorials.

You will receive a notification email with the Shipping Receipt Number shortly after your ordered product is shipped.

We provide convenience and certainty for customers in making transactions with Omid Health Style by implementing an online payment system when customers make online product purchases using the Visa/Master payment system options and all transactions will be processed in Indonesian Rupiah.

Notice to the User will be deemed to have been received by the User if and when:

We may demonstrate that the communication, whether in physical or electronic form, has been sent to that User, or
We have posted the notice in a place on the Omid Health Style website that is accessible to the public without charge.

Closing

We and the User are independent entities and no agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship is created or implied by this Agreement.
The headings in this Agreement are for reference only and in no way define, limit, explain or describe the scope or scope of such section.
Our failure to exercise our right to assert our rights under this Agreement or our failure to take action against a User’s breach of this Agreement shall not waive or prejudice our right to take action against similar or subsequent breaches.
